Terms of Service

1. Service Description

ReefCast AI is an AI-powered fishing platform that provides catch logging, trip planning, boat management, GPS mapping, and regulatory information for anglers. By accessing or using ReefCast AI (“the Service”), you agree to be bound by these Terms of Service.

2. Account Registration

You must be at least 16 years of age to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@reefcastai.com if you suspect unauthorised access.

3. Subscriptions and Billing

ReefCast AI offers free and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) and are processed securely through Stripe. By subscribing to a paid plan, you authorise us to charge your payment method at the start of each billing period.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time. We reserve the right to modify pricing with 30 days' notice via email.

4. Acceptable Use

You agree not to use the Service to:

• Plan, facilitate, or conceal illegal fishing activities, including taking protected species or fishing in closed zones.
• Abuse, overload, or attempt to circumvent usage limits or AI query quotas.
• Reverse-engineer, scrape, or extract data from the platform in bulk.
• Upload content that is unlawful, harmful, or infringes the rights of others.
• Attempt to gain unauthorised access to other users' accounts or platform infrastructure.

Violations may result in immediate suspension or termination of your account without refund.

5. Intellectual Property

The ReefCast AI platform, including its software, design, AI models, and content (excluding user-submitted data), is owned by ReefCast AI and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.

You retain ownership of all data you submit to the Service, including catch logs, waypoints, and photos. By submitting data, you grant ReefCast AI a limited licence to process and store that data solely to provide the Service.

6. Data Accuracy Disclaimer

AI-generated recommendations, species identifications, and fishing insights are provided for informational purposes only and are not guaranteed to be accurate, complete, or current. Fishing regulations, closed seasons, and species limits can change. Always verify current regulations with the relevant Queensland or Commonwealth authority before fishing.

ReefCast AI is not responsible for fines, penalties, or losses arising from reliance on AI-generated content or regulatory information displayed in the app.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ReefCast AI and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you to ReefCast AI in the 12 months preceding the claim.

8. Termination

You may terminate your account at any time by contacting support or using the account deletion option in settings. We reserve the right to suspend or terminate your account if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately and your data will be deleted in accordance with our Privacy Policy.

9. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
